Driver Shot with Taser Gun

Each day, dozens of motorists get arrested in Boulder for Driving under the Influence (DUI), many times unfairly.  Our Boulder DUI lawyers have witnessed plenty of incidents in which a driver was arrested for intoxicated driving without just cause.  Motorists are often arrested despite their BAC level being within legal limits, for readings obtained from a faulty breathalyzer device, or because of officer suspicion of DUI alone– all incidents that can be contested in a court of law.

Then there are times when an officer uses excessive force on a driver to illicit cooperation, an act which blatantly infringes upon the individual’s rights, especially if the driver did not pose an actual physical threat to the officer.

Unfortunately, many motorists are the victims of excessive police force in Boulder and it’s imperative they know they have a right to take legal action. Many officers may try to deny wrongdoing, but an experienced Boulder DUI lawyer will know exactly what to do to protect the victim’s rights.

Just last week, a Boulder driver was shot with a Taser after allegedly refusing to cooperate during a DUI stop.

According to reports on the incident, the driver, a 49-year-old man, was stopped by a Boulder police officer on Friday night after noticing there was a defective tail light on the vehicle and alleging he rolled through a stop sign. After approaching the driver, the officer reported she smelled alcohol on his breath and that his eyes were red and watery.

The officer’s report said the man claimed to have only had one beer and was “500 feet” from his home. He was unable to provide registration for the vehicle and his insurance was expired.

When a second officer then arrived on scene the driver reportedly refused to get out of the car and drove off, partially hitting one of the officers.

The two officers then followed the driver to his home where one pointed a gun at the man and the other pointed a Taser while ordering him to get out of the car. When he did not, the officers approached the driver side door, opened it and found the man with his fists balled up by his chest.

At this point, one of the officers shot the man with the Taser, causing him to fall on the floor.

The man then allegedly accused the officers of being “instigators” and that driving drunk wasn’t even the actual issue at hand.

Nevertheless, the man was arrested on several charges: DUI, failure to provide proof of insurance, reckless driving, obstructing a police officer, resisting arrest, vehicular eluding, and two counts of second-degree assault.

If this case seems over the top, it’s only one of several where even greater excessive force has been used. The man appears to know his rights and may be able to have all the charges dropped, especially the DUI charge since the report did not say a breathalyzer test was performed.
